USCIS has announced two significant changes that will impact many adjustment of status (Form I-485) applicants.
1. A new Form I-485 is coming.
Beginning September 18, 2026, USCIS will require applicants to use a revised Form I-485. If an older version of the form is postmarked or submitted electronically on or after that date, USCIS will reject it.
2. Public charge rules are changing.
The Department of Homeland Security has rescinded the 2022 public charge regulation. According to DHS, USCIS officers will once again evaluate adjustment of status applicants under a broader public charge standard, considering all relevant factors on a case-by-case basis as permitted under the Immigration and Nationality Act.
